This Privacy Policy ("Privacy Policy") describes how we, PT Transcosmos Indonesia ("Company" or "TCID"), collect, use, store, protect and process personal data about you during and after your employment relationship with us if you are our employee, worker, candidate, vendor and contractor (collectively, "Personal Data Subject") in accordance with the Indonesian law on personal data protection No. 27 of 2022, as amended from time to time.

It is important that you read and retain this Privacy Policy, along with any other privacy notices we may provide on certain occasions when we collect and process personal data about you so that you are aware of how and why we collect and process such data and what your rights are under personal data protection regulations.

This Privacy Policy does not constitute the point of an employment contract or any other contract to provide services and this Privacy Policy may be updated at any time, the Company will notify you of such updates as soon as possible.

The Company may transfer your personal data to third parties that may be located overseas, including Japan, Thailand, Malaysia, the Philippines, Singapore, and Vietnam. Any personal data held by or on behalf of us is stored on secure servers with modern security measures to protect against loss, unauthorized access, alteration, or misuse of the information. If such personal data is stored by unrelated third parties on our behalf, we have also imposed contractual obligations on those parties to ensure the confidentiality and security of the information.

However, despite our safeguards and efforts to secure personal data, please be aware that no data security measures can guarantee 100% security. There may be incidents that affect the functioning and security of the Company's systems and interfere with our ability to maintain the performance of contracts/employment related to employment to the highest standards. Nonetheless, we strive to protect your personal data and will make the necessary responses in such circumstances in accordance with applicable laws.

Storing Personal Data

  1. Processing of personal data will commence from the moment we obtain your personal data in the manner described in this Privacy Policy in accordance with applicable law.
  2. The Company will retain your personal data for the purposes listed in point 2 purpose of use of personal data and the number of years after the end of the employment as required for the purposes as stated in point 2 use of personal data.
  3. The Company will cease the processing of personal data at the end of the retention period as described in this Section or in any other case under law.
  4. When the aforementioned retention period expires, or the personal data is no longer required for legal purposes or in other cases as required by law, we will take steps to destroy or anonymize the personal data and if such action is impractical (for example, if such personal data has been stored in a backup archive), we will retain the personal data in accordance with the company’s policy on retention periods, until deletion can be carried out and ensure that no new processing occurs thereafter in accordance with our document retention and disposal policies, as well as applicable laws and regulations.

    • Crushing process
      The Company selects the relevant personal data to be destroyed and destroys it with the consent of the data protection officer (DPO) according to information handling procedure.
    • Crushing method
      We destroy personal data recorded and stored in the form of electronic files by using technical methods (e.g., low-level formats) to ensure that records are not reproducible, while personal data recorded and stored in paper document form must be shredded or burned.

You may exercise, among other rights as stipulated by law, the following rights in relation to your personal data in accordance with the manuals, policies, and internal rules we may implement from time to time in accordance with applicable regulations:

    • You have the right to give or withhold consent to the processing of your personal data, except in certain circumstances as specified by law.
  3. Right to access data
    • You have the right to access your personal data to view, correct, or request correction of your personal data unless otherwise specified by law.
  4. Right to withdraw consent
    • You have the right to withdraw your consent to the processing of your personal data unless otherwise specified by law.
    • If you withdraw your consent, we may not be able to fully perform contracts, work, or tasks related to your employment relationship with us.
    • Withdrawal does not affect the legality of prior processing.
    • The withdrawal statement must be in writing/printed, including electronic or verified formats. We will inform you of the potential consequences of such withdrawal.
  5. Right to erasure
    • Unless otherwise specified by law, you have the right to erase your personal data.
    • If the erasure affects contract performance, we may not be able to fulfill it completely.
  6. Right to restrict data processing
    • You have the right to request restrictions on the processing of your personal data unless otherwise specified by law.
    • The request must be implemented within 72 hours of lawful receipt.
    • The restriction may affect contract/work performance.
  7. Right to request data provision
    • You have the right to request personal data that you have provided during our services/employment, unless otherwise specified by law.
  8. Right to object to data processing
    • You have the right to object to the processing of your personal data:
      1. to prevent/limit data disclosure, or
      2. for advertising and marketing purposes, unless otherwise specified by law. We will fulfill your request within 72 hours of receiving a lawful request unless otherwise specified by law.
  9. Right to complain, denounce, and sue
    • You have the right to file complaints, denunciations, and legal claims if we violate personal data protection regulations.
  10. Right to claim compensation
    • You have the right to claim compensation in accordance with applicable legal procedures.
  11. Right to self-protection
    • You have the right to self-protection in accordance with the Civil Code and other laws.

To assert your rights as a data subject, please contact us and we will process your request in accordance with applicable law. We may, if permitted by law, charge a reasonable fee to cover the cost of responding to such request. Each request must include sufficient details to identify you. Once received, we may request additional information from you (including proof of identity) to process your request. Please note that it may take some time to process your request, but we aim to process all requests as soon as possible. We may also charge a reasonable fee to cover our administrative costs in handling any request, which we will inform you of in advance.
